WHEREAS, the City Council of the City of Atlantic City is authorized pursuant to N.J.S.A. 40:12-21 to enter into a private
sale with a duly incorporated non-profit organization to transfer real property for normal consideration; and
WHEREAS,
during the period from 1933 to 1945, six (6) million Jews and millions of other Europeans were murdered as part of a carefully
orchestrated program of culture, social and political genocide known as the Holocaust; and
WHEREAS, THE ATLANTIC CITY
BOARDWALK HOLOCAUST MEMORIAL, INC., a New Jersey non-profit Corporation has requested the conveyance and dedication of an
area in Kentucky Avenue Boardwalk Pavilion to construct a monument to those who perished in the Holocaust, and
WHEREAS,
the conveyance and dedication of the area and the construction of the memorial is in the best interest of the City of Atlantic
City and will serve to educate and remind future generations of the Holocaust, and
WHEREAS, by Ordinance 78 of 2007,
the City of Atlantic City conveyed and dedicated an area at Iowa Avenue and the Boardwalk for this use but necessary environmental
permits were denied for that location, and
WHEREAS, by Resolution 105 of 2007, the City of Atlantic City also recommended
that an area provided at Kennedy Plaza on the Boardwalk fo this use, and
WHEREAS, the City Council of the City of Atlantic
City has determined that this subject property is not needed for municipal purposes, and
WHEREAS, THE ATLANTIC CITY
BOARDWALK HOLOCAUST MEMORIAL, INC., represents that the property shall be used for the benefit of the general public and not
for any sectarian, religious or political purposes, and
