PUBLIC ORDINANCE

PUBLIC ORDINANCE NO. 35 OF 2008
OF THE CITY OF ATLANTIC CITY, N.J.
PREPARED BY THE LEGISLATIVE COUNCIL 
MAY 7, 2008 
 
AN ORDINANCE DEDICATING AN AREA ON THE BOARDWALK,
LOCATED IN THE CITY OF ATLANTIC CITY
KNOWN AS KENTUCKY AVENUE PAVILION,
TO BE KNOWN AS
THE ATLANTIC CITY BOARDWALK HOLOCAUST MEMORIAL. 

WHEREAS, the City Council of the City of Atlantic City is authorized pursuant to N.J.S.A. 40:12-21 to enter into a private sale with a duly incorporated non-profit organization to transfer real property for normal consideration; and

WHEREAS, during the period from 1933 to 1945, six (6) million Jews and millions of other Europeans were murdered as part of a carefully orchestrated program of culture, social and political genocide known as the Holocaust; and

WHEREAS, THE ATLANTIC CITY BOARDWALK HOLOCAUST MEMORIAL, INC., a New Jersey non-profit Corporation has requested the conveyance and dedication of an area in Kentucky Avenue Boardwalk Pavilion to construct a monument to those who perished in the Holocaust, and

WHEREAS, the conveyance and dedication of the area and the construction of the memorial is in the best interest of the City of Atlantic City and will serve to educate and remind future generations of the Holocaust, and

WHEREAS, by Ordinance 78 of 2007, the City of Atlantic City conveyed and dedicated an area at Iowa Avenue and the Boardwalk for this use but necessary environmental permits were denied for that location, and

WHEREAS, by Resolution 105 of 2007, the City of Atlantic City also recommended that an area provided at Kennedy Plaza on the Boardwalk fo this use, and

WHEREAS, the City Council of the City of Atlantic City has determined that this subject property is not needed for municipal purposes, and

WHEREAS, THE ATLANTIC CITY BOARDWALK HOLOCAUST MEMORIAL, INC., represents that the property shall be used for the benefit of the general public and not for any sectarian, religious or political purposes, and

 

NOW, THEREFORE, BE IT ORDAINED
BY THE COUNCIL OF THE CITY OF ATLANTIC CITY
THAT
 
 
SECTION 1. The area of Kentucky Avenue and the Boardwalk, shown on the picture attached hereto and as shall be more particularly described in the property description that will be attached to the agreement, is so conveyed and dedicated to the ATLANTIC CITY BOARDWALK HOLOCAUST MEMORIAL, INC., for the construction of a memorial for the use and purpose herein.
 
SECTION 2. The dedication and conveyance is conditioned to the ATLANTIC CITY BOARDWALK MEMORIAL, INC.'s raising of sufficient funds to erect and maintain such memorial within two (2) years following that date all necessary governmental approvals are received and the subsequent construction of such memorial in accordance with the agreement attached hereto. Said agreement is incorporated by reference and made part of this Ordinance.
 
SECTION 3. If said conditions of the Agreement are not fulfilled or the land ceases to be used for the purposes contained herein, the land shall thereupon revert to the City of Atlantic City.
 
SECTION 4. The Mayor and City Clerk are hereby authorized to execute an Agreement in the form attached hereto, upon review and approval of the City Solicitor as to form and execution, to effectuate the provisions of this Ordinance.
 
SECTION 5. All prior Ordinances inconsistent with this ordinance are hereby rescinded.
 
SECTION 6. The Ordinance shall take effect immediately upon its final passage and publication, as provided by law.
